			<description><![CDATA[Salam Us, Pertanyaan sy ade kaitan dgn Sukuk Musharakah Venture Capital & Musharakah Mutanaqisah (MM) utk Property Financing. Ade kaitan jg dgn 'Preferential Treatment dlm artikel & dr ape yg sy faham ianye dibolehkn based on tanazul (ibra') concept. Fokus isu - abandon project for property financing. Dlm MM financing, ikut AAOIFI Istisna' applied. In the event of abandon project, bank can redeem capital due frm customer sbb dlm Istisna' scr langsung melantik customer as a developer to complete the project. Rumah xsiap consider negligence at customer's end (Betulkn sy Us klu sy salah fahaman). Bukan semua bank perlu comply with AAOIFI jd ade yg propose utk apply venture capital & include 'Preferential Treatment' dlm MM structure. As customer da promise (wa'ad mulzim) utk beli bank's share gradually (even bila project rumah tak complete), customer dikire breach of contract & bank are allowed to redeem capital due atas sbb breaching td. Sy difahamkn ade persamaan dgn 'Preferential Treatment' td. Pendapat akal sy, jika rumah tu xsiap maka share tu tiade nilai dlm musharakah. 'Prefential Treatment' tu hanye dibolehkn jika company gain profit, profit didahulukn kpd preference shareholder based on tanazul & jika company wind up, asset company perlu dicairkn dan capital akan dipulangkan kpd preference shareholder dahulu. Dlm kes abandon project tiada asset yg blh dicairkn sbb asset belum wujud. Harap dpt penjelasan Us.]]></description>
